These Terms of Use (“Terms”) govern your access to and use of the website located at highaltitude.llc (the “Site”), operated by High Altitude LLC (“we,” “us,” or “High Altitude”). By accessing the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Acceptance
Your use of the Site constitutes acceptance of these Terms and of our Privacy Policy. These Terms apply to this corporate website only. Subsidiary products operated by High Altitude LLC have their own terms published at their own domains.
2. Permitted use
You may use the Site to learn about High Altitude LLC, review our services and participation models, and contact us. You agree not to:
- Attempt to disrupt, overload, or interfere with the Site or its infrastructure.
- Use automated means to scrape content at a rate that materially burdens the Site.
- Use the Site to transmit malware, spam, or abusive content.
- Misrepresent your identity when submitting the contact form or otherwise communicating with us.
- Use the Site in violation of applicable US federal, Arizona state, or local law.
3. Intellectual property
All content on the Site — including text, graphics, logos, the mountain mark, typography selections, and design system — is owned by or licensed to High Altitude LLC and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content except as expressly permitted in writing.
Third-party trademarks referenced on the Site (for example, Microsoft, Azure, Dynamics 365) remain the property of their respective owners.
4. Third-party links
The Site may contain links to third-party sites we do not control. We are not responsible for the content, privacy practices, or terms of those sites. Links do not constitute endorsement.
5. Your submissions
When you submit information through the contact form or via email, you grant High Altitude LLC a limited, non-exclusive, royalty-free license to use that information solely to respond to you and maintain records of our communication. We do not claim ownership of ideas or materials you send.
Confidentiality: we treat submitted ideas as confidential from first contact. However, these Terms alone do not create an NDA. Formal confidentiality obligations arise only under a separately executed mutual non-disclosure agreement. See our Support page for how to request one.
6. Warranty disclaimer
The Site is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, High Altitude LLC disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content. We do not warrant that the Site will be uninterrupted, error-free, or secure.
7. Limitation of liability
To the fullest extent permitted by law, in no event shall High Altitude LLC, its managers, members, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site. Our aggregate liability for any claim arising out of or related to the Site shall not exceed one hundred dollars (US $100).
8. Indemnification
You agree to indemnify and hold harmless High Altitude LLC from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site.
9. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms. The provisions that by their nature should survive termination (including intellectual property, warranty disclaimer, limitation of liability, indemnification, and governing law) will survive.
10. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of or related to the Site or these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
11. Changes & effective date
We may update these Terms from time to time. Material changes will be announced at least 30 days before they take effect by updating the effective date above and posting a notice on this page. Non-material corrections may take effect immediately.
